Consent form for processing candidate's personal and sensitive data

1. This Consent Form ("Form") is used to gain informed consent from candidates (“Data Subject”) for processing your personal data, especially through ClockWork platform, whether they are collected directly by Kinp Group in public databases and social networks (ex. Linkedin) or provided by the Data Subject by sending a resume, according to the General Data Protection Regulation (GDPR) and Brazilian Geral Data Protection Law ("Lei Geral de Proteção de Dados" – LGPD) .

2. By accepting this Form, the Data Subject provides consent and authorizes the company KINP RECURSOS HUMANOS LTDA, a legal entity governed by private law, simply referred to as "KINP GROUP", registered in the Brazilian national register of legal entities under n. 27.401.536/0001-75, with headquarters located at Av. Queiroz Filho, 1560, room 107, Beija Flor Tower, Vila Hamburguesa, São Paulo/SP, Brazil, CEP 05.319-000, to use personal and identifiable data, in addition to personal characteristics, including personal sensitive data of ethnicity, race, deficiency (data concerning health) and/or sexual orientation - collected through KINP GROUP's own form or given by mere liberality of the candidate in his resume – for the purposes of:

  • operationalization of recruitment and selection procedures; and
  • assistance in promoting affirmative inclusion policies and internal diversity programs at our client companies;

emaining authorized the data storage in KINP GROUP´s database, including own and outsourced databases from KINP GROUP to carry out future selection processes and for historical purposes for the time deemed necessary for these purposes.

3. Regarding the mentioned sensitive data that may be collected, both GDPR and Brazilian LGPD provides that the legal basis on which founds its processing is the consent of the Data Subject, given freely and specifically, in accordance with article 7 of GDPR and article 11 of LGPD. By signing this Form, you agree with the processing of your sensitive personal data by KINP GROUP, as well as sharing it with our client companies, solely and exclusively for the purposes mentioned above.

4. The Data Subject declares to understand that KINP GROUP is, in this context, the “Controller” of your personal data, under the terms of the GDPR and LGPD, responsible for determining the purposes and means of treatment, having the duty to delete the data collected, when: 

  • these are no longer necessary to fulfill the purpose authorized above; or 
  • when requested by the Data Subject in the exercise of his rights (topic 6).vide item 6).  

5. The use of personal data of any nature by KINP GROUP for purposes other than those specified above is prohibited, including, but not limited to, the use, improper sharing with third parties and commercialization of this information.  

According to the article 7 of GDPR and article 18, IX, of LGPD, the Data Subject can withdraw this consent at any time, upon express request sent to the email: dpo@kinpgroup.com. The revocation of consent for the processing of personal data or direct request for eliminate will result in the irreversible exclusion of the personal data provided by the Data Subject, except in cases where its retention is based on another “legal basis”, such as compliance with a legal/regulatory obligation or the defense of KINP GROUP in judicial, administrative or arbitration proceedings, in which case the Data Subject will be duly informed.

7. The exercise of the rights of access, rectification and erasure of the data (article 15, 16, 17 of GDPR and article 18 of LGPD), may be exercised directly by the Data Subject through the Clockwork platform.
